Minnesota Adult-Use Cannabis Laws

Minnesota legalized adult-use cannabis in May 2023. Adults 21 and older can legally purchase, possess, and consume cannabis products from licensed dispensaries.

Possession Limits (Age 21+)

  • In public: Up to 2 ounces of cannabis flower
  • In public: Up to 8 grams of cannabis concentrate
  • In public: Up to 800 mg of THC in edible form
  • At home: Up to 2 pounds of cannabis flower
  • Home cultivation: Up to 8 plants per residence (4 mature maximum)

Where You Can Consume

  • Private residences (with owner permission)
  • Designated consumption areas (when licensed)
  • Public places (parks, sidewalks, streets)
  • Vehicles (driver or passenger)
  • Within 250 feet of schools during school hours
  • Federal property

Total Tax Rate: 21.875%

  • 15% Cannabis Excise Tax (state)
  • 6.875% Sales Tax (state)

Note: Medical cannabis patients are exempt from the 6.875% sales tax.
